Anonymous company bids to set consumer product safety policy in secret court proceedings?

Is this how policy is made and justice meted out in the United States today?  The Consumer Product Safety Commission establishes a website where consumers can find data on product complaints.  A company files a federal lawsuit, under seal, seeking to overturn the CPSC's authority to maintain the website, and gets permission to keep the proceedings secret?  For the moment, yes.  And this is not China; not Iran; not North Korea.  It is our country and our court.  Our forefathers would roll over in their graves.  Let's hope the presiding judge injects some sanity into this action and makes the public court system public when it decides national policy on consumer protection.
