$12,000 sanction for failing to attend mediation is upheld.
Daniel Goldman appealed to the Court of Appeals after the Grand Traverse County Circuit Court assessed $12,000 in sanctions against him for failing to appear at a court-ordered Mediation. Since the sanction represented the cost incurred by the other parties to attend two unnecessary hearings, the Court of Appeals deemed the fine an appropriate exercise of discretion and not excessive. The Court also upheld a $42,000.00 verdict for breach of contract against the argument that it was excessive.
