Sixth Circuit holds that employer can discontinue retiree health benefits.
In Witmer et al. v. Acument Global Technologies, Inc., et al., a divided panel of the Sixth Judicial Appellate Court ruled that the employer could legally reduce or eliminate retiree health benefits. The Court held that the employer had expressly reserved the right to modify or terminate benefits, and therefore the retirees could not argue that they had retired in reliance on health care benefits or otherwise acquired a vested interest in benefits.
