Jury verdict in age discimination upheld
Last week, the Sixth Circuit announced that it would not disturb a jury verdict in favor of Jon Spengler and against Worthington Cylinders. Spengler claimed that Worthington violated the Age Discrimination in Employment Act when it allowed him to be fired after he questioned his supervisor's comments suggesting age bias. Spengler was a part-time employee seeking full-time status--and getting good reviews--before his supervisor suggested he transfer to another department where he wouldn't "have trouble keeping up with the younger guys." He questioned the motivation for his transfer, incurring the supervisor's wrath and a retaliatory firing for his "negative attitude."
