Fired employee cannot sue Board of Directors of Niles Housing Commission

Michigan's immunity statute confers immunity from liability upon "the highest appointive executive official of all levels of government."  When David Martin sued the Niles Housing Commission and several individuals, the trial judge interpreted this statute to protect the executive hired by the Housing Commission.  The Court of Appeals disagreed and conferred immunity upon the Housing Commission's Board of Directors, finding the Commission to be a "level of government" and the Board to be its executive.
