Federal Court holds it will not enforce illegal election-of-remedies clause in union contract

In Trayling v. St. Joseph County, the Federal District Court summarily agreed with the fired employee that her union and employer could not force her to choose between administrative and legal remedies after alleged age and disability discrimination by the employer. The Sixth Circuit refused to grant an interlocutory appeal by the County.
