Court reverses premature summary disposition of ADA claim arising out of employer's requirement of psychological counseling
In Kroll v. White Lake Ambulance Authority, the Court of Appeals overturned the lower court's summary disposition of the plaintiff's ADA claim. The Plaintiff argued that her employer discriminated against her when it fired her for refusing to undergo psychological counseling. The higher court ruled that there was a genuine issue of material fact with regard to whether the order was a legitimate exercise of business necessity, or rather retaliation against Kroll's perceived emotional disability arising out of a busted relationship.
