Court enforces prior arbitration and settlement agreement and discharges teacher
In Heffelfinger v. Bad Axe Pub. Schs., the Court of Appeals determined that the employer did not do a bad job of "axing" a tenured teacher. The school had attempted to discharge Heffelfinger after arguing that he used excessive force against a student. This claim was resolved at arbitration with a stipulation to resign in the event of a second incident. The School Board "accepted" his resignation after a second incident was alleged, and the teacher argued that its action in discharging him violated the Teacher Tenure Act--and that he was entitled to a more appropriate procedure. The Court of Appeals summarily rejected his argument.
