Court allows Detroit Diesel to renege on promise of retirement health benefits
This week the Sixth Circuit ruled that Detroit Diesel had the right to discontinue paying health benefits to retirees, thus altering its "undisputed pre-existing commitment to provide fully-funded lifetime health care benefits to its retirees." Judge David McKeague was the sole dissenter in Wood, et al., v. Detroit Diesel Corp., arguing that there was no basis in the contractual documents or sound public policy to allow Detroit Diesel to escape from the fundamental, vested duty it had promised to retirees.
