Arbitration agreement is not incorporated into financial service/insurance employment contract
The Hantz Group, Inc., an insurance broker, and related companies sued Jason Van Duyn and other former employees arguing that they were in breach of a confidentiality clause related to their employment agreement. The Circuit Court declined jurisdiction over the case and sent it to binding arbitration, holding that the employees' employment agreement arbitration clause applied to related companies' contracts. The Court of Appeals reversed and sent the case back to the Circuit judge, holding that several of the related plaintiff companies were not bound by the arbitration clause in the employment agreement signed by the Defendants.
